Receivership: Execution is not deemed as an acknowledgement

Supreme Court, 12 Jan. 2016, n°14-11943: The decision of the receiver to proceed with the execution of an on-going contract concerning assets subject of an application for recovery of ownership cannot be deemed as an acknowledgement of the said ownership. Therefore, the lessor who files an application for recovery within the legal time must still pursue the fulfillment of all legal formalities in this respect, under penalty of foreclosure.
