Supreme Court, 15 Dec. 2015, n°14-12348: A vessel can validly be arrested for recovery of its ownership on the basis of the Code of Civil Procedures of Execution, in particular article 222-2, which provides that any person who seems to be entitled to claim the delivery or recovery of a moveable asset can proceed to its attachment so to make it unavailable. The yard cannot validly challenge the arrest on the grounds of the 1952 Brussels Convention and the Code of Transports, which concern conservatory arrests of vessels.
